The 13.709/2018, also known as the General Data Protection Law, was published on August 14, 2018, and addresses the protection of personal data. The law became effective on September 18, 2020, aiming to ensure the protection of individuals who are data subjects, who provide their data to companies located within Brazilian territory. To guarantee this protection to individuals, the LGPD established rules applicable to ALL companies for the use of this data, providing legal security to individuals, always aiming to minimize possible impacts on individual rights and guarantees of freedom, privacy, and free personality development of the data subject (protection of the rights of the data subject).

This Privacy Notice describes in a simple and clear manner FINTALK's procedures and practices regarding the processing of personal data. We provide information on how the collection, processing, and sharing of Personal Data of users of our website is done. This Notice applies to anyone who accesses the site https://fintalk.ai so that we can process the necessary information to offer our products and services, always reinforcing transparency in our relationship. 4. Who are we and how to contact us?

Fintalk provides technology for its clients to speak directly with their consumers. The company offers all the infrastructure to optimize service channels through artificial intelligence – all through audio conversations. Thus, customers can pay bills, place orders, and access other services via app or social networks. Our activity is carried out in full compliance with applicable Brazilian laws, as well as Resolution no 3.954/2011 of the CMN - National Monetary Council. In this Privacy Notice, references to "we" are to FINTALK S.A

5. What personal data do we collect and how do we collect it?

Data is collected on behalf of contracting clients for the exclusive use of contractors. We collect only the strictly necessary data for forwarding:Proposals for opening a checking account and credit operations; Proposals for credit card requests; Refinancing proposals with guarantee; Information updates; Opening tickets; etc. We collect only the necessary data so that our partners can properly track the proposals and projects.


6. Data Storage Location

The data we use is stored on secure servers of our business partners/operators, such as AWS, Google, and Microsoft, which are our suppliers of computing environment and applications, in the “Cloud Computing” modality, also known as the public cloud. The captured data can be used for the period defined by the contractor up to a maximum of 365 days when they are completely deleted.


7. Legal bases for processing personal data

We only process Personal Data when we have a legal basis to do so, in the following cases:Due to legal or regulatory obligation: covers situations where the purpose is to comply with Brazilian legislationDue to contractual necessity or preliminary contractual procedures: covers situations where we must process Personal Data to fulfill our contractual obligations or preliminary contractual preparation.Due to the Controller's legitimate interest: covers the use of personal data for activities related to promotion, prospecting, and general offering of credit and/or financial products and services from our partners, which are Banks and other financial institutions.IMPORTANT: We ensure that data processing carried out based on legitimate interest is performed in full compliance with the General Data Protection Law, always prevailing the fundamental rights and freedoms of the data subject, who can opt-out at any time.

In cases where FINTALK intends to process personal data for a different purpose from which they were originally collected, we will provide information about this other purpose and any additional relevant information before such processing. FINTALK does not use personal data in automated decision-making processes.


9. How and when does FINTALK share personal data with third parties

FINTALK may share personal data it holds in the following cases:for credit operation mediation purposes, where FINTALK, acting as Correspondent, can share data with the financial institution for credit analysis and granting;due to legal or regulatory obligation; or for the purpose of fulfilling its contractual obligations with its clients. The data sharing procedure is carried out in full compliance with the LGPD, and if the personal data subject decides to exercise the rights listed in article 18 of the LGPD, particularly correction, deletion, anonymization, or blocking of data, FINTALK will promptly comply with the request, under § 6 of article 18, immediately informing any processing agents with which data sharing was carried out to replicate the same procedure, except in cases where this communication is proven to be impossible or implies disproportionate effort.


10. How do we keep your personal data secure?

FINTALK takes all necessary security measures to restrict access to the Personal Data processed, to protect against unauthorized or illegal processing and against accidental damage, loss, or destruction of your Personal Data. The security measures applied by FINTALK include storing your personal data on secure servers and granting access to personal data only to authorized individuals, when necessary, to achieve a specific purpose.


11. How long do we store your personal data?

Personal Data is retained for as long as necessary concerning the purpose for which we are processing that information, and in accordance with legal requirements (when applicable). To determine the appropriate retention period for Personal Data, we consider: the amount, nature, and sensitivity of the Personal Data; the potential risk of harm from unauthorized use or disclosure of your Personal Data; the purposes for which we process your Personal Data and if we can achieve the same objectives by other means, using applicable legal bases and appropriate security measures.
